2. Intellectual Property & DMCA Notice

GroDigital respects the intellectual property rights of others. In compliance with the Digital Millennium Copyright Act (“DMCA”), we will respond to notices of alleged copyright infringement.

2.1 Submitting a DMCA Notice

A valid DMCA notice must include:

• Your name, address, phone number, and email
• Identification of the copyrighted work
• Identification of the allegedly infringing material with sufficient detail
• A statement of good-faith belief that the use is unauthorized
• A statement under penalty of perjury that your claim is accurate
• Your physical or electronic signature

2.2 Counter-Notification

If you believe the removed material was taken down in error, you may submit a counter-notification including:

• Identification of the removed material
• A statement under penalty of perjury that the removal was a mistake
• Consent to jurisdiction in the state or federal courts of Kansas
• Your physical or electronic signature

Upon receiving a valid counter-notification, we may restore the material unless the original claimant files a court action.

3. Data Processing Addendum (DPA)

This section applies when GroDigital processes personal information on behalf of a client or partner as part of our services.

3.1 Roles

• The Controller determines the purpose and means of processing.
• GroDigital acts as a Processor when handling data on behalf of the Controller.

GroDigital does not sell or share personal information processed for clients.

3.2 Purpose of Processing

We process personal information solely to:

• Deliver and optimize performance marketing services
• Support analytics, attribution, and reporting
• Improve service functionality
• Perform contracted operational tasks

We do not process data for independent or unrelated purposes.

3.3 Types of Personal Information

May include (depending on services):

• Contact information
• Device and interaction data
• Attribution and engagement data
• High-level behavioral insights

We do not intentionally process sensitive personal information.

3.4 Security

GroDigital maintains reasonable administrative, technical, and physical safeguards to protect personal information.

3.5 Subprocessors

We may use trusted subprocessors (hosting providers, email systems, analytics, etc.) strictly to perform service tasks for GroDigital. All subprocessors must follow contractual privacy and security obligations.

3.6 Assistance With Requests

When required, GroDigital will assist Controllers in responding to privacy requests — access, deletion, correction, or other applicable rights.

3.7 Retention and Deletion

Data is retained only as long as needed to fulfill the service or as required by law. Upon request or contract termination, GroDigital will delete or return personal information unless retention is legally required.

3.8 International Transfers

If applicable, appropriate safeguards (e.g., standard contractual clauses) will be used.

3.9 Compliance

GroDigital agrees to:

• Process data only as instructed
• Not sell or share data
• Not combine or cross-use data improperly
• Maintain robust security procedures
